II. PERSONAL DATA COLLECTED

For clients and suppliers, we collect information such as name, contact phone number, email address, and billing information, including Federal Taxpayer Registration Number (RFC) and fiscal address.

For candidates applying to a vacancy, we collect personal identification and/or contact details such as name, date of birth, age, place of birth, marital status, gender, number of children, social security number, address, email address, phone number, Federal Taxpayer Registration Number (RFC), Unique Population Registry Code (CURP), a freely formatted CV, salary and benefits received, position and team under their supervision, and general information from employment references.‍

III. PURPOSE OF PROCESSING PERSONAL DATA

The personal data in the possession of the responsible party will be used for the following purposes:

a) Purposes necessary to maintain the relationship with the data subject:

- The execution and fulfillment of the services provided by the responsible party.
- Invoicing and collection related to the commercial relationship.
- Keeping records for service tracking or product acquisition.

b) Additional purposes:

- Your data may be used to request commercial references about the responsible party. Personal data in the possession of the responsible party regarding candidates for any type of vacancy will be used for the following purposes:

a) Purposes necessary for the candidate's participation in a vacancy:

- To analyze and compare skills and qualifications to determine if the candidate meets the requirements of the vacancy.
- To contact the data subject directly for job interviews.
- To validate personal and employment references provided by the data subject to confirm their profile.
- To propose the data subject as a candidate for a vacancy with one of our clients.

b) Additional purposes:

- If the data subject is not selected for the process they participated in, they may be considered for other available vacancies.

If data subjects do not wish for the responsible party to process their personal data for purposes that are not necessary to maintain the relationship, as mentioned above, they have five days to express their refusal by sending an email to info@protal.mx.

IV.- METHODS OF COLLECTING YOUR DATA

Clients and suppliers are informed that their data is collected directly by the responsible party when requesting information, quotes, services, placing service orders, requesting invoices, or participating in surveys or other promotional activities. In the case of suppliers, the data is collected directly to fulfill the obligations of the commercial relationship.For potential candidates, data may be collected through public and private websites legally dedicated to publishing profiles and resumes of individuals seeking employment and directly when, after being contacted, the individual decides to provide further necessary information to apply for a vacancy.

V.- DATA TRANSFER

Clients and suppliers are informed that their data may be transferred to entities that require commercial references for the responsible party. Candidates or applicants for any vacancy are informed that the information collected from them will be transferred to our clients if they agree to participate in the selection and recruitment process as candidates, based on the executive profiles requested by our clients. The responsible party may hire one or more third-party service providers to collect and manage personal data, such as companies that manage social media pages or advertising agencies that assist in delivering the responsible party’s advertisements. Therefore, the responsible party may transfer your data to these third parties solely for the purpose of providing the contracted services, and these third parties will be required to treat personal data in accordance with this privacy notice. By providing your personal data, you accept that the responsible party may carry out such a transfer exclusively for the purpose stated in this paragraph.

VI.- LIMITATION ON THE USE OF PERSONAL DATA

VI.- REQUEST FOR ACCESS, RECTIFICATION, CANCELLATION, OR OBJECTION TO PERSONAL DATA AND WITHDRAWAL OF CONSENT (ARCO REQUEST)

Data subjects are informed that they have the right to access their personal data held by the responsible party and to know the details of their processing, as well as to rectify them if they are inaccurate or incomplete; cancel them once the purposes of the processing have been fulfilled, and object to their processing.

VIII.- MEANS TO EXERCISE ARCO RIGHTS (ACCESS, RECTIFICATION, CANCELLATION, OR OBJECTION)

To initiate an ARCO request, the data subject must submit a written request addressed to our Personal Data Department at info@protal.mx, Monday to Friday, from 9:00AM to 6:30 PM, containing the following information:

I. The name of the data subject and an address or other means to communicate the response to their request; II. Documents proving the identity of the data subject or, where applicable, their legal representation; III. A clear and precise description of the personal data for which one seeks to exercise any of the aforementionedrights, and any other element or document that facilitates the location of the personal data.

The responsible party’s Personal Data Department will process your request in strict accordance with the guidelines established in the Federal Law on Protection of Personal Data Held by Private Parties, notifying you of the response via email.

IX.- WITHDRAWAL OF CONSENT FOR THE PROCESSING OF YOUR DATA

At any time, you may revoke the consent you have given us for processing your data for the purposes outlined in section b) of paragraph IV of this notice, so that we cease using it. To do so, you must submit your request under the terms outlined in the previous section. Regarding the purposes outlined in section a) of the cited paragraph, you may revoke your consent once the purposes of the processing have been fulfilled, considering the administrative, accounting, tax, legal, and historical aspects of the information.

X.- MODIFICATIONS TO THE PRIVACY NOTICE

We reserve the right to make changes or updates to this privacy notice at any time, in response to legislative changes, internal policies, or new requirements for providing or offering our services. These changes will be available to the public through our website www.protal.mx.
